Executive Order No. 0130-2021

 

IMPLEMENTING UPDATED TRAVEL GUIDELINES

AND REITERATING PROVISIONS OF

E.O. NO. 102-2021 AND E.O. 125-2021

 

WHEREAS, Section 15, Article II of the 1987 Philippine Constitution and Section 16 of Republic Act No. 7160 otherwise known as the Local Government Code of 1991 provide that Local Government Units within their territorial jurisdiction shall promote health and safety of the people;

 

WHEREAS, due to the nationwide spread of Corona Virus Disease 2019 (Covid-19), the Philippines is declared to be under State of Public Health Emergency and continues to be under State of Calamity pursuant to Proclamation No. 1218, S. 2021 promulgated by President Rodrigo Roa Duterte;

 

WHEREAS, through Executive Order No. 112, s. 2020 signed by President Rodrigo Roa Duterte, the Omnibus Guidelines for the Implementation of Community Quarantine in the Philippines (Omnibus Guidelines) issued and periodically updated by the national IATF-EID is adopted for the implementation of health and quarantine protocols for different quarantine classifications in the Philippines;

 

WHEREAS, Pangasinan experienced an unusual and alarming increase in Covid-19 cases since August 19, 2021, with reasons to believe that a community transmission of the Delta (B.1.617) variant is ongoing, resulting in the classification of several component LGUs as Critical Zones and in the reaching of maximum capacities of Covid-19 wards in public and private hospitals in Pangasinan;

 

WHEREAS, due to the foregoing, and after appeal by the Pangasinan IATF, the national IATF-EID placed the Province of Pangasinan under General Community Quarantine (GCQ) with heightened restrictions from September 8-30, 2021 pursuant to Resolution No. 136-F (s. 2021);

 

WHEREAS, the Office of the Governor of the Province of Pangasinan issued Executive Order No. 102-2021 prescribing guidelines for the implementation of GCQ with heightened restrictions in Pangasinan;

 

WHEREAS, the risk classification of Pangasinan as GCQ with heightened restrictions was maintained from October 1-31, 2021 pursuant to IATF-EID Resolution No. 141-A (s. 2021) and IATF-EID Resolution No. 143-A (s. 2021);

 

WHEREAS, there is a need to clarify the guidelines in Executive Order No. 102-2021 in view of the current issuances of pertinent government agencies and recent modifications in the Omnibus Guidelines and the Alert Level System guidelines made by the national IATF-EID;

 

NOW, THEREFORE, I, AMADO I. ESPINO III, Governor of the Province of Pangasinan, by virtue of the powers vested in me, do hereby order the following:

 

SECTION 1. UPDATED TRAVEL GUIDELINES.

  1. Essential travels or travels by Authorized Persons Outside Residence (APORs) as designated by the IATF-EID or the PNP, coming from any zones, shall continue to be allowed in the Province of Pangasinan. Such APORs shall include but not be limited to frontline services, government personnel, emergency medical cases, public transportation, and movement of cargo.
    1. APORs from the government shall be required to present a valid or government-issued ID, a travel order or itinerary, and to pass symptom-screening;
    2. Other APORs may present their employment certificates, travel order, hospital referrals, and other proof of authority to travel.
  2. Non-APORs and tourists coming from areas under the following quarantine classifications shall not be allowed into the borders of Pangasinan:
    1. Enhanced Community Quarantine (ECQ);
    2. Modified Enhanced Community Quarantine (MECQ);
    3. Granular lockdown;
    4. Alert Level 5;
    5. Alert Level 4. Leisure travel from areas under Alert Level 4 to areas under GCQ with heightened restrictions is not permitted (Department of Tourism Administrative Order No. 2021-006).
  3. Non-APORs and tourists coming from areas under Alert Level 2-3 may be allowed interzonal travel to Pangasinan, subject to the requirements in this Section, and other reasonable restrictions based on age and comorbidities as may be determined by the component LGUs subject to the oversight, monitoring, and evaluation of the respective local IATF.
    1. Component LGUs may prohibit the interzonal travel of those from Alert Level 2-3 that are below eighteen (18) years of age, and belonging to the vulnerable population, namely, those who are over sixty-five (65) years of age, those with immunodeficiencies, comorbidities, or other health risks, and pregnant women.
    2. The above notwithstanding, fully vaccinated individuals from Alert Level 2-3 that belong to the vulnerable population and those below eighteen (18) years of age shall be allowed to participate in specialized markets of the Department of Tourism such as Point-to-Point travel subject to the reasonable regulations of the LGU of destination, and Staycations. (Alert Levels System guidelines as of October 13, 2021)
  4. For non-APORs and tourists from provinces under General Community Quarantine (GCQ) and Modified General Community Quarantine (MGCQ), and from places under Alert Level 1, travel shall be allowed subject to the requirements in this Section.
  5. For all allowed interzonal travels except APORs, the traveler shall secure a negative RT-PCR or rapid antigen test result before travel as requirement to be presented at border checkpoints. The LGU of destination may impose additional regulations, such as those based on age and comorbidities, in their respective jurisdictions.
  6. A Covid-19 domestic vaccination card shall serve as sufficient alternative to any testing required by the LGU. Provided, that the traveler shall undergo health and exposure screening upon arrival at the destination LGU.
  7. All persons allowed to travel, except APORs travelling to Pangasinan, must secure their corresponding permits from the S-PASS Travel Management System at https://s-pass.ph, which shall be presented at the border checkpoints along with the aforementioned negative Covid-19 tests or Covid-19 vaccination cards, and when required by the LGU of destination.
  8. Any person who is using or is attempting to use a forged, fake, fraudulent vaccination card and S-PASS permit, or who submitted fraudulent requirements in the S-PASS shall be denied entry to Pangasinan without prejudice to prosecution under existing laws or ordinances.

 

SECTION 2. TOURIST TRAVEL AND ATTRACTIONS.

  1. All tourists are required to register with Pangasinan Tara Na at https://pangasinan.tarana.ph/.
  2. Outdoor tourist attractions, as may defined by the Department of Tourism, are allowed at thirty percent (30%) venue capacity with strict adherence to minimum public health standards. Indoor tourist attractions shall not be allowed to operate. (IATF-EID Resolution No. 141-A, S. 2021)
  3. Tourist travel must be point-to-point, i.e., pit stops and stopovers for eating and personal necessities are allowed, but no side trips to other destinations shall be permitted. (DOT Advisory No. 13, series of 2021)
  4. Multiple-Use Hotels and Regular Hotels, with capacity dependent on whether or not a Certificate of Authority to Operate was secured from DOT, may admit Leisure Guests. (DOT Admin. Order No. 2021-004)

 

SECTION 3. EFFECTIVITY OF PREVIOUS EXECUTIVE ORDERS. In view of the maintained classification of Pangasinan as under GCQ with heightened restrictions pursuant to IATF-EID Resolution No. 141-A (s. 2021) and Resolution No. 143-A (s. 2021), the implementing guidelines in Executive Order No. 102-2021 as well as the guidelines for the observance of Undas 2021 in Pangasinan under Executive Order No. 125-2021 shall remain effective insofar as they are not inconsistent with the present Executive Order.

 

SECTION 4. SEPARABILITY CLAUSE. Should any provision of this Order be declared by a court of competent authority as invalid or unconstitutional, the remaining provisions not adversely affected thereby shall remain in full force and effect.

 

SECTION 5. EFFECTIVITY CLAUSE. This Order shall take effect immediately until or unless subsequently amended/revoked/revised. All orders, rules, regulations, promulgations, circulars, and/or issuances by the IATF and/or concerned national government offices/agencies are hereby adopted. All previous issuances of the undersigned and/or by component LGUs, which are not in contravention of the IATF Resolutions and/or its member agencies shall be made applicable in a suppletory manner.
