PROVINCIAL RESOLUTION NO. 222-2011



DECLARING ORDINANCE NO. 2011-68 OF THE SANGGUNIANG BAYAN OF MANGALDAN, PANGASINAN, ENTITLED “AN ORDINANCE CREATING TWELVE (12) POSITIONS NAMELY: TWO (2) ADMINISTRATIVE OFFICER IV (SG-15) AT THE OFFICE OF THE MUNICIPAL MAYOR, FIVE (5) ADMINISTRATIVE AIDE II (SG-2) UNDER THE OFFICE OF THE MARKET SUPERVISOR AND FIVE (5) ADMINISTRATIVE AIDE II (SG-2) UNDER THE OFFICE OF THE SLAUGHTERHOUSE MASTER AND PROVIDING APPROPRIATIONS THEREFOR” AS WITHIN THE CONFERRED POWERS OF THE SANGGUNIANG BAYAN TO ENACT


WHEREAS, the Sangguniang Bayan of Mangaldan, Pangasinan submitted its Ordinance No. 2011-68 to the Sangguniang Panlalawigan for review and evaluation pursuant to Section 56 of R.A. No. 7160, otherwise known as the Local Government Code of 1991;

WHEREAS, the Committee on Laws and Ordinances of the Sangguniang Panlalawigan, with the technical assistance of the Local Finance Committee, have conducted initial review and study on said ordinance and found out that the same was enacted pursuant to Sections 76 and 447 (a) (1) (viii) of RA 7160;

WHEREAS, the salaries and insurances of the twelve (12) new positions are included in the 2011 Annual Budget;

WHEREAS, the municipality has not exceeded the Personal Services Cap under Section 325 (a) of RA 7160;

WHEREAS, the salaries of the ten (10) new Administrative Aide II are exempted from the computation of Personal Services limitation as they are under the Economic Enterprise offices;

WHEREAS, Section 2 of said Ordinance only stated the objectives in the creation of the new positions.  However, the qualifications, duties and responsibilities of the new positions are not enumerated.  Therefore, the qualifications, duties and responsibilities of the new positions should also be enumerated;

WHEREAS, the Sangguniang Panlalawigan, after final evaluation, finds the subject ordinance in order;

WHEREFORE, in view of the foregoing, on motion of SP Members Jeremy Agerico B. Rosario and Mojamito R. Libunao, Jr.  and co-sponsored by SP Members Amadeo T. Espino, Salvador S. Perez, Jr. and John Christopher A. Arcinue, duly seconded, it was –

RESOLVED, by the Sangguniang Panlalawigan in session assembled, to declare Ordinance No. 2011-68 of the Sangguniang Bayan of Mangaldan, Pangasinan, entitled “An Ordinance creating twelve (12) positions namely: two (2) Administrative Officer IV (SG-15) at the Office of the Municipal Mayor, five (5) Administrative Aide II (SG-2) under the Office of the Market Supervisor  and  five (5) Administrative Aide II (SG2) under the Office of the Slaughterhouse Master and providing appropriations therefor” as within the conferred powers of the Sangguniang Bayan to enact;

RESOLVED FURTHER, that copies of this resolution be furnished the Office of the Municipal Mayor and the Office of the Sangguniang Bayan of Mangaldan, Pangasinan, for their information and guidance.
